Mobile application terms and conditions for the Greene King App (the “App”)

Please read these terms and conditions carefully before using the App operated by Greene King Brewing and Retailing Limited.

These terms and conditions apply to your use of the Greene King mobile App, which is hosted on the Apple iTunes App, and the Google Play store. The way in which you use this App is also controlled by the relevant App store rules and policies. If you disagree with any part of these terms and conditions, then you must not access the App.

User Requirements - In order to use the App and access its services, you must meet the following user requirements:

You must be aged 18 or over to download and use the App;

To order products via the App you must be at the premises where you wish to purchase products and have a table number.

If alcoholic or age-restricted products are purchased, both the purchaser and any intended consumer must be aged 18 or over and able to provide valid ID upon request. If you (or any member of your group who is the intended consumer) are unable to provide proof that you are aged 18 or over to the satisfaction of our staff, or if our staff reasonably believe that the alcohol you have purchased has been purchased by you for someone under the age of 18, we reserve the right not to complete the order;

Your admission to licensed premises and service by the pub team is subject to licensing laws as well as any applicable Greene King policies or procedures. The pub manager may exercise their sole discretion to refuse to serve any guest or to make any other decision with the intention of observing and upholding the licensing objectives, as well as any applicable Greene King policies or procedures;

You must have a debit card, credit card, GooglePay or ApplePay to place an order.

Changing terms and conditions - We can change these terms and conditions at any time. You are advised to check the terms and conditions before ordering each time.

Updating App - From time to time we may automatically update the App and change the service to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively, we may ask you to update the App for these reasons. If you choose not to install such updates or if you opt out of automatic updates you may not be able to continue using the App and the services.

Acceptable use restrictions - You must not use the App or any service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms, or act fraudulently or maliciously. For example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the App, any service or any operating system. You must not infringe our intellectual property rights or those of any third party in relation to your use of the App or any service (to the extent that such use is not licensed by these terms); not transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the App or any service; not use the App or any service in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and not collect or harvest any information or data from any service or our systems or attempt to decipher any transmissions to or from the servers running any service.

All products and offers are subject to availability. The pub manager may offer alternative products at their sole discretion or a refund.

Any refunds due will be processed through the pub’s till. Refunded sums will be returned to the card or account you paid with within 72 hours.

You are strongly advised to check your order before you submit it. Once you complete your order you will enter into a binding contract that cannot be amended or cancelled.

Liability due to downloading the app - Greene King accepts no responsibility for any damage or data loss caused to your mobile telephone or handheld device as a result of downloading the App.

Nothing in these terms and conditions affects your statutory rights. We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors or for fraud or fraudulent misrepresentation. Our total liability to you in respect of all other losses arising under or in connection with the App or your use of them, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed twice the value of your order or £100, whichever is lower.

Intellectual property rights - All intellectual property rights in the App, and the services throughout the world belong to us (or our licensors) and the rights in the App and the services are licensed (not sold) to you. You have no intellectual property rights in, or to, the App, or the services other than the right to use them in accordance with these terms.
